Main Points

These are the main points of the agreement that apply to the use of ClimateHero's services.

• Service overview: ClimateHero helps individuals and businesses calculate their emissions, identify ways to reduce them, and balance their remaining emissions by funding verified climate solutions.
• Business calculator: The ClimateHero Business Calculator operates under its own separate License Agreement, as referenced in §1.
• Climate funding: ClimateHero offers subscription-based and one-off climate funding services for individuals and businesses. Details are set out in §3.
• Pricing: Subscription prices are stable and may be adjusted once per year with at least 30 days' notice. One-off prices apply at the time of purchase. Details are set out in §4.
• Climate solutions: ClimateHero offers three types of climate solutions: avoided emissions (certified by Gold Standard), long-term carbon removal through biochar, and sustainable aviation fuel (SAF).
• Communication: You will receive occasional emails with updates and tips, with an option to unsubscribe.
• Privacy: Your personal information is protected and shared only as necessary to provide services or comply with legal requirements.

Please note that the above is a summary for convenience only. The full Terms and Conditions below constitute the legally binding agreement between you and ClimateHero.

1. General

These Terms and Conditions (the "Terms") apply to the services provided by ClimateHero (the "Service") between ClimateHero AB ("ClimateHero") and you ("the User").

ClimateHero offers a comprehensive range of Services designed to help Users calculate, reduce, and balance their emissions. These Services cater to both individuals and businesses.

Balancing emissions means funding climate solutions that reduce or remove CO₂ from the atmosphere, contributing to meaningful global emissions reduction.

These Terms apply to all ClimateHero services except the Business Calculator, which is governed by a separate License Agreement available at business-calculator.climatehero.org.

2. Usage of the Service

The User may use the Service for personal or internal business purposes, unless otherwise agreed with ClimateHero. ClimateHero reserves the right, at its own discretion, to suspend or terminate Users who are deemed to violate the Terms or otherwise misuse the Service. ClimateHero may also block a User account for a certain period in order to investigate any breach of contract.

The User confirms their identity in the Service through their email address, and in the case of purchases, through payment by credit card or other selected payment method. This applies to all Services, including those for both individuals and businesses, where Users engage via an online service without direct interaction with a ClimateHero representative. ClimateHero cannot be held responsible for unauthorized use of the Service if the User's email address or credit card is used by an unauthorized person.

3. Guidelines for Climate Funding

Climate solutions

ClimateHero offers three types of verified climate solutions:

• Avoided emissions, certified by Gold Standard. Accelerates the green transition through certified climate projects.
• Long-term carbon removal. Pyrolysis of residual biomass into biochar, stably stored in soil for hundreds of years.
• Sustainable aviation fuel. Jet fuel made from waste materials such as used cooking oil, replacing fossil jet fuel.

Unless otherwise clearly stated at the point of purchase or in a separate agreement, climate funding is directed to ClimateHero's portfolio of Gold Standard certified climate projects. For certain products a combination of climate solutions may be used.

The guidelines for ClimateHero's climate solutions are reviewed annually and can be found at climatehero.org/fund/our-approach.

Climate funding for individuals

ClimateHero offers Users the option to balance emissions through a monthly subscription or through one-off purchases, either for specific activities such as flights, car trips or events, or for climate gifts and individual tonnes of CO₂e.

For monthly subscriptions:

• If the subscription is based on an estimated carbon footprint, 200% of that footprint is balanced each year. Footprints above 15 tonnes of CO₂e per person are calculated as 15 tonnes, so the maximum balanced is 30 tonnes of CO₂e per person per year.
• If no footprint estimate has been made, 10 tonnes of CO₂e per person per year is balanced.
• If the User chooses to include additional adults, they are assumed to have the same carbon footprint as the User. Children are assumed to have half the carbon footprint of the User.

When completing a one-off purchase, ClimateHero funds climate solutions corresponding to the emissions associated with the selected activity or purchased volume.

Climate funding for businesses

The Terms for individuals also apply to purchases made by businesses. For businesses receiving tailored support through ClimateHero's Consulting Services, the climate funding strategy is agreed individually and the standard guidelines above may not apply.

4. Prices

Prices for climate solutions are outlined in ClimateHero's price list, available on our website.

For subscription services, any price adjustments will be made no more than once per calendar year and will be communicated to the User at least 30 days before taking effect.

For one-off purchases, the price applicable at the time of purchase applies.

ClimateHero assumes no responsibility for any tax implications arising from the User's use of the Service.

5. Changes to the Service

ClimateHero reserves the right to make updates and changes to the Service at any time.

6. Rights

All intellectual property rights relating to the Service, including, but not limited to, copyright to software and source code, are ClimateHero's exclusive property and remain with ClimateHero. The User does not receive any license or other right to use such rights through the use of the Service.

7. Personal Data

ClimateHero is the personal data controller for the processing of the personal data that the User submits to ClimateHero. The personal data is processed in accordance with ClimateHero's privacy policy, which the User must approve in order to use the Service and which can be read separately at climatehero.org/privacy-policy.

ClimateHero uses the User's personal data in order to identify the User, communicate with the User, process the User's personal data to fulfill this agreement, for statistical purposes, and otherwise administer the Service.

The User agrees that ClimateHero will send newsletters containing information about the Service and offers from partners to the User's registered email address. The User always has the opportunity to unsubscribe from future newsletters by clicking on the link provided in each newsletter for this purpose.

The User has the right to request an extract of the personal data that is processed about the User at ClimateHero, regardless of how these are collected. The User can also request rectification, modification or updating of registered information if this cannot be done on their own in the Service. If Users wish to access or change the information, a request must be submitted to ClimateHero via email. The request is sent to hello@climatehero.org from the User's email address registered in the Service.

If the User's personal information has been processed in violation of GDPR, the User is entitled to request that the personal data be corrected, blocked or deleted. The User may at any time request that identifiable personal data be permanently deleted by terminating their account through an email to hello@climatehero.org.

8. Availability and Responsibility for Online Services

The Service is available in several languages. Please note that translations into languages other than English may be incomplete or inaccurate.

All emissions estimates provided through the Service are indicative only. They are not audited or verified figures and should not be relied upon as the sole basis for business, financial, or reporting decisions.

The Service is provided to the User without any obligations to provide support and ClimateHero does not provide any warranties, explicit or implicit, as far as the Service, its design, functionality or accessibility is concerned, which means that ClimateHero has no responsibility towards the User or others if the Service is unavailable to the User, whether this is due to maintenance, updates, technical problems or any other circumstance.

Through its provision of the Service, ClimateHero will not become a party to any agreement made by the User through the use of the Service and may under no circumstances be held liable to the User for any legal acts effected through the use of the Service, or otherwise for direct, indirect or consequential damages, whether foreseeable or unforeseeable and regardless of the cause of the claim, derived from the User's use of the Service.

9. Termination

For climate funding subscriptions, the User may change or terminate their subscription at any time by sending a request to hello@climatehero.org from their registered email address. Termination takes effect 30 days after the request is received. Any payment falling due before that date is charged as normal.

ClimateHero reserves the right, at its own discretion, to terminate these Terms with immediate effect, to permanently close the User's account, or to suspend the User temporarily if (i) the User violates the Terms, (ii) a third-party claim is directed against ClimateHero in connection with the User's use of the Service, or (iii) ClimateHero otherwise decides for commercial or other reasons, for example as a result of a judgment or authority decision, to no longer provide the Service. Upon termination, the User shall immediately cease use of the Service.

10. Changes to the Terms

Prices and price adjustments are governed by §4. Changes to the Service are governed by §5. For all other changes, ClimateHero may update these Terms at any time. Where a change materially affects the User's rights or obligations, ClimateHero will inform the User by email to their registered address. Minor changes that do not affect the User's rights, such as corrections and clarifications, may be made without notice.

ClimateHero may apply a change immediately if required by law, regulation, or a court or authority decision, and will inform the User as soon as possible.

If the User does not accept a change, the User may cease use of the Service immediately and terminate this agreement. For subscriptions, termination takes effect in accordance with the 30 day notice period in §9.

11. Dispute

Swedish law shall apply to these Terms. Disputes arising out of these Terms shall be settled in a Swedish public court, with the Stockholm District Court as the court of first instance.
